Really it's a appreciate step taken by EEOC - Employment Opportunity Commission to give the proper right to the employees. These rules must be followed for any disabled employee. It would be more appreciated if the ADA could mentioned some of the reasonable accommodation should be given to a disabled employee by the employer.

Whatever happened to the law Congress passed in 1992 that was supposed to establish a free national title database that would alert all states about a damaged car as soon at it was identified as damaged in one state? That would have helped both the dealership and the consumer because based on this article, there is a chance the dealership didn't know about the car's history if it was a recent acquisition (no smell in winter), and if the title had been cleaned at some point.

The Global Reporting initiative is interesting, however it seems like the rest of the world is still about a decade behind the states as far as compliance is concerned. In Germany, while there is interest in compliance, only companies that are listed in US markets, and therefore required to follow SOX guidelines, have compliance systems in place. Even things like audits, inspections, etc. are the exception, rather than the rule for mid-sized companies (200-1000 employees) in Germany.

Interesting post though. No Twitter or Linkedin to follow??

It doesn't matter if the harasser was joking, it only matters how the harassed interpreted the situation. Even if it was something that was meant as a joke, there is a line that employees can't cross. Employers have to recognize a potential problem long before there is one if they don't want to deal with a huge mess in the long run.

Good point. We don't just want to see how well we performed when an accident occurred, but focus on what an improved safety program is preventing.

it seems to me if and while we are setting parameters that they should be something that would first be considered to be consistent with our society formation and reasonable to the primary benefit of all. therefor it would seem that a minimum wage might also illustrate a glaring need for a MAXIMUM wage. although our politicians know maximum wages should be and are established for our society servants, it seems to me that our general morals would dictate that our greedy executives simply demand more pay because they can. i tend to thing salaries of 3 or 5 or 56 million per year and 10 million $ bonuses have contributed greatly to the present world wide economic burdens placed on the minimum and/or reasonable wage earners. we consider our freedoms so important that we allow them to damage us when our politicians don't act in our interests because the lobbying big money dictates. while we allow our political buyout we act unbibically in contrast to the high road many of us think we are on. bibically however ROMANS 13 SAYS THAT ALL AUTHORITY COMES FROM ABOVE AND THAT IF YOU DON'T AGREE WITH THAT ESTABLISHED AUTHORITY YOU OPPOSE GOD WITH CONSEQUENCES TO COME.

I totally agree, if you want to make a good hiring decision, then a background check and dot drug testing are a must. You really don’t know who you are hiring, if you don't do these tests.

Nice post. More companies than ever now advertise health and safety jobs in order to employ qualified occupational health and safety officers who can record, monitor and implement all relevant safety issues to ensure compliance. Knowing that their employees are being professionally trained and informed in how to avoid risks will also make employers feel more confident in their staff and working environment.

Good advice Kathryn. Assessment testing helps you round out your overall screening of a candidate, and in many cases, it saves you time and money by avoiding bad hires.

The Fair Labor Standards Act is federal law however the new DOL enforcement position is certain to be challenged in court, as in the past some court have found that service advisors are exempt. KPA and our parters, Ford & Harrison and Fine, Boggs & Perkins will be monitoring this issue with additional updates to follow.

The Fair Labor Standards Act has always considered service advisors non exempt, however the Department of Labor had not been enforcing this actively. The new position indicates they will begin enforcement. It is highly possible that the matter will end up in court since this is a significant change. KPA and our partner, Ford and Harrison, will continue to monitor the situation and provide updates as additional information become available.
